1. Scope
These general terms and conditions apply to all short and long-term stays in apartments operated by Baser Gastro AG (ODA Suites).
They apply regardless of whether the booking is made directly or via third-party platforms (in particular online travel agencies such as Airbnb or Booking.com).
When booking via third-party platforms, their conditions prevail. These terms and conditions apply in addition, unless the terms and conditions of the third-party platforms contain any deviating regulations.
2. Conclusion of contract
The contract is concluded with the booking confirmation.
As part of the booking process, the person making the booking confirms that they have taken note of these terms and conditions and that they have accepted them.
- via the website or booking tool
- via third-party platforms (e.g. Airbnb, Booking.com)
3. Services
The subject of the booking is the temporary provision of a furnished apartment for temporary use.
It is expressly not about a tenancy within the meaning of tenancy law, but a short-term accommodation service with a service character.
The specific scope of services is set out in the respective booking confirmation.
4. Prices and Payment
All prices are in CHF.
Payment is made exclusively online in accordance with the conditions specified when booking.
In the event of late payment, Baser Gastro AG is entitled to dissolve the contract without notice and refuse access to the apartment.
5. Short and long-term stays
The following categories apply:
- Short term stays: up to 28 nights
- Long-term stays: 28 nights or more
The specific conditions are based on the respective booking.
6. Check-in and check-out
- Check-in: from 15:00
- Check-out: by 11:00
The guest is required to leave the apartment completely vacated and in good condition at the time of check-out.
Late check-outs may be charged at additional costs (e.g. daily rate).
Defects must be reported immediately upon arrival, otherwise the apartment is considered to have been properly taken over.
7. Cancellation
The cancellation conditions agreed upon booking apply.
For direct bookings, the following also applies:
- In case of no-show, the full booking amount may be charged.
- Tourist taxes that have already been paid will be refunded in full in the event of a no-show.
When booking via third-party platforms, their conditions prevail.
Refunds will be made within a reasonable period of time (usually within 14 working days).
8. Use and conduct
The apartments may only be used for residential purposes.
In particular, the following are not allowed:
- parties or events
- Sublease
- occupancy by more people than stated in the booking
- bringing or keeping pets (excluding service animals)
- commercial or commercial uses without prior written consent
- professional photo and video productions for commercial purposes without prior written consent
- disruptive behavior towards neighbors, other guests or third parties
- use for illegal, immoral or otherwise prohibited purposes
- any use that violates house rules or applicable law
The house rules are an integral part of these terms and conditions and are binding to comply with.
In the event of violations, Baser Gastro AG reserves the right to:
- Issuing warnings
- Expenses to be charged
- to end your stay without notice
9. Right of access
Baser Gastro AG is entitled to enter apartments after prior notice, in particular:
- for cleaning
- for maintenance
- to fix technical faults
- in case of suspicion of breaches of contract
In emergencies, access is permitted at any time without notice.
10. Liability
The person making the booking is liable for all damage caused by them or accompanying persons.
This includes in particular:
- Damage to equipment and inventory
- Loss of keys or access systems
- extraordinary contamination
- improper use
Baser Gastro AG is entitled to charge these costs.
11. Damage caused by guests
The person making the booking is liable for all damage to the apartment, furniture, inventory, technical equipment and common areas caused by themselves, fellow travelers, visitors or animals brought by them.
This applies in particular to:
- damage to furniture, walls, floors, appliances and textiles
- loss or damage to keys, access media or equipment
- extraordinary contamination with additional cleaning costs
- Damages as a result of improper or contrary to contract use
Baser Gastro AG is entitled to charge for proven damage and additional expenses.
12. deposit/security deposit
Baser Gastro AG may request a deposit or security deposit before or during your stay.
The amount of the deposit, the form of deposit and the conditions depend on the respective booking or booking confirmation.
Baser Gastro AG is entitled to offset outstanding claims, damage, additional cleaning, missing or damaged items and other costs resulting from the stay against the deposit.
Any remaining amount will be refunded within a reasonable period of time after completion of the audit (usually within 14 working days).
13. Items left behind
Items left behind will be kept for a limited time. Baser Gastro AG assumes no liability for this.
Shipping is only carried out at the request and expense of the guest.
14. data protection
The current version of personal data applies to the processing of personal data privacy policy from Baser Gastro AG.
15. Applicable Law and Jurisdiction
Swiss law is exclusively applicable. The place of jurisdiction is Lucerne.
